Datuk Seri Ong Tee Keat is also the MCA President.  He reveals that the PKFZ involved MCA internally. Political and commercial forces have infiltrated into the party, these forces have even expressed that they are willing to uproot him at all cost.

What irks Ong most is that hese forces intend to show a value that those who investigated the fiasco is worse than those who created it.  They are trying to create a harmonious facade, which they think is more important than the truth. Read more…

An interesting interview with the Minister of Transport and MCA President appears as front page headline on Sin Chew Daily (Evening Edition)today. 

Ong has been the limelight recently as Opposition leader Lim Kit Siang made request in public for Ong to be accountable for the PKFZ fiasco.

MFN produced the translation for the said interview as follows:

Kuala Lumpur July 15, Minister of Transport Dato Seri Ong Tee Keat revealed that few powers tried to prevent him from making public the PWC report on PKFZ.

The restraining power came from those personally involved, political and commercial power that combined power with those involved, and certain individuals in the governing parties, he claims.

“The have taken measures to threaten my personal safety, applying internal pressures to stop me from releasing the report.”

During the interview with Sin Chew Daily, Ong shares his feelings and various encounter while handling PKFZ fiasco after assuming the position of the Minister of Transport last year.

His safety was under threat

He describes that the combination of few powers has besieged him.  These include the joint forces of political and commercial power to prevent him from releasing the report; and after the report is made public, he has been slammed with various untrue allegation by Chinese opposition parties.

He also claims that some had even engaged the underworld to convey message that if he vanishes one day, he would know what has happened. Read more…

Tee Keat and predecessors to be summoned for PKFZ scandal

(吉隆坡一日讯)国会公共帐务委员会将在未来两周内传召交长翁诗杰、两位前交长陈广财、林良实,总检查长、国会后坐议员主席张庆信为巴生自由港口丑闻作证。

公共帐务委员会主席阿兹米表示该委员会在今天的会议里已决定要传召的证人和问题。他同时表示已有数名官员和部长被传召作证。

KUALA LUMPUR, July 1 — The Public Accounts Committee (PAC) will summon the Ong Tee Keat, Ling Liong Sik, Chan Kong Choy the attorney-general and Backbencher Tiong Hing King to testify over the PKFZ scandal in this coming two weeks.

PAC chairman Datuk Seri Azmi Khalid said that they have finalised the witness to be summoned and the set of question to be asked. He also confirmed that few senior civil servants and ministers have been called to testified.

本網站最近接獲神秘郵寄文件,拆開後才知道原來是陳廣才當年簽署的支持信保證信

有關信函的內容包括

1.我們清楚知道巴生港務局與KDSB的發展合約;

2.在1963年港務局法令下,巴生港務局是交通部屬下合法機構;

3.大型分銷中心計劃或自由區是一項國家計劃,並提高我國在港口運輸的競爭力。因此,港務局支付貸款的能力是很關鍵的,以確保計劃成功落實。

因此(a)我們將在任何及未來時候確保港務局有能力支付貨款,以及(b)我們不會採取行動,以致巴生港務局採取任何導致該局沒有能力遵守其須支付的款項

普華永道稽查報告指出,交通部在2003年5月至2006年5月期間發出4封巴生港務局對KDSB繳付流動現金的支持信。

根據翁詩傑在去年12月公佈的第一份調查報告,首封誌期2003年5月28日發給MIMB公司及太平洋托管公司的支持信是由林良實簽署;其餘3封則是由時任交長陳廣才簽署。

MFN received mysterious posting from anonymous party, only to realized that it was a copy of the Letter of Support issued by Chan Kong Choy.

The content of the letter includes:
1.    We (Ministry of Transport) are fully aware of the Development Agreement entered between PKA and KDSB;
2.    PKA is a statutory authority established under the Port Authorities Act 1963 under the purview of the Ministry of Transport;
3.    The Mega Distribution Zone Project/Free Zone area is a national project; it is vital in the competitive edge in our nation trans-shipment.  The ability of PKA to pay the balance of the repayment is critical to ensure the successful implementation and completion of the said project.  As such (a) We shall at all times in the future ensure that PKA is in the position to meet (and do meet on a timely basis) to meet their liabilities in respect of the Repayment Amount for so long as an amount in respect of the Repayment amount remains outstanding, and (b) we shall not take any action or cause PKA to take any action which may result in PKA being unable to perform its obligation in respect of the Repayment Amount.

According to PWC’s audited report, the Ministry of Transport has issued 4 letters of support from May 2003 till May 2006 in respect of repayment by PKA to KDSB.
According to the first report release d by Ong Tee Keat, the first letter dated 28 May 2003 was issued by Ling Liong Sik to MIMB and Pacific Trustee, while the rest were issued by Chan Kong Choy.

敦林良實與丹斯里陳廣才簽發給KDSB的“支持信”除了內容有差異,簽發過程與程序也有不同。

除了普華古柏調查指出,林良實與陳廣才簽定的支持信不同之處是“陳廣才的信中有表明非擔保信”之外,其實還有一個未為人知的程序問題。

有可靠消息指出,林良實在簽發第一封支持信時,時任交通部秘書長及部門法律顧問都有在場,並記錄在交通部的會議記錄,是合符一般程序。不過,在陳廣才接任交長職後,不知是否獲得錯誤訊息,陳氏或認為“既有先例,便照樣發出下一封信”,而是在秘書長與法律顧問的缺席下,自行簽發有關信函。

內閣是同意發展巴生港口自由區的計劃,但問題是,這項計劃的第二階段與第三階段,涉及數以千萬或億令吉的發展工程,陳廣才不曾提呈到內閣討論,這也導致內閣無法有效監督自由區的發展與開銷。在缺乏政府的有效監督下,原本的11億令吉的自由區計劃,卻發展到耗資46億令吉,增幅超過兩倍。

根據1963年港口法令(Port Authority Act)13(1)及(2)條文,港務局總經理是一個全職的執行經理,擁有執行權負責整個港口的行政責任,但其權限是否能大到去簽署與通過耗資數億令吉的大型發展計劃呢?

據前港務局主席拿督葉炳漢之前在報章上透露,港務局主席的任務是出席當局的董事會會議,以及聆聽所有呈報到董事會的報告。因此,涉及如此龐大的費用,以及關係巴生港口生存與發展的計劃,難道港務局董事部真的“不聞不問”,任由一個負責行政工作的總經理做出一切決定?

據消息指出,事實上,自由區計劃的第二階段與第三階段發展都是由巴生港務局董事部所通過,而當時的港務局主席便是有“政壇九命貓”之稱,曾跟陳廣才同一個陣營的葉炳漢,兩人也被疑在自由區計劃中有利益關係。

葉炳漢是在2004年4日受委為港務局主席,直到2007年4月,共任兩屆。

據知,葉炳漢的任期原本只是一屆兩年,而馬華原本是不再推荐葉炳漢,惟陳廣才知悉後而自行拜會阿都拉,以延長葉氏的任期。

前交通部長丹斯里陳廣才是受官員的“誤導咨詢”下,才自行簽發“支持信”,讓KDSB獲得更大的利潤?

2007年8月的內閣會議曾討論巴生港口自由區的事項,包括要追究為何政府在“不知情”的情況下,承擔或保證一家私人公司高達數十億令吉的貸款,同時也指示當局去追查時任交長陳廣才是否獲得“錯誤資訊”而自行簽發3封支持信給KDSB。

當時內閣要陳廣才針對此事解釋與提呈報告,因為為一家私人公司貸款作擔保,是不曾在內閣討論。

有一項消息指出,由政府簽發給KDSB的支持信,足以讓KDSB獲得信貸評估機構發出“AAA”等級,以發放低息債券,而陳廣才簽發這些信後,也將獲得應有的“酬勞”。有謠言,陳廣才在這項交易中,個人獲得8千萬令吉現金,而這筆錢也通過雲頂“洗乾淨”了。 Read more…

翁诗杰:林吉祥扭曲事实 - Ong Tee Keat on PKFZ: Kit Siang is hysterical

(吉隆坡22日讯) 翁诗杰指责林吉祥扭曲普华永道报告,更指其行为歇斯底里。

翁诗杰是在回答林吉祥的问题 : 为何在之凿凿要毫无包庇公开何巴生自由港口报告之后,却迟迟不公开这份牵涉公币的报告。

翁诗杰表示,报告迟迟不能公开因为政府必须解除这些文件为官方机密,同时普华永道也要求保障自己被起诉。

他指出,该报告必须在公开于民众之前提呈于内阁。

目前已经300份报告运抵国会有秘书处分发予议员们

KUALA LUMPUR, June 22 —Ong accused DAP’s Lim Kit Siang of twisting the facts of the audit report and described the move as “hysteria”.

He was replying to a question by Lim Kit Siang who queried reason for the the delay in making public the PKFZ report despite the Ong Tee Keat initial vow not to conceal any weaknesses or offenses in relation to the scandal which involves public funds.

Ong said, the delay was caused because the government had to remove the report from the Official Secrets Act while PWC wanted to be indemnified from legal action.He further pointed out that the report also had to be tabled before the Cabinet before it could be released to the public.

300 complete copies of the report had already been delivered to Parliament and it was now up to the secretariat to distribute it to MPs.

8個月前,翁詩傑信誓旦旦表示要公開巴生港口自由區的調查報告,但一直拖延到迄今才公開,其中一謠言指翁詩傑是不滿國陣後座議員理事會及Wijaya有限公司首席執行員拿督斯里張慶信,不守承諾支付有關“處理費”而撕破臉皮!

謠言傳出,翁詩傑與張慶信有一項“協議”,一旦完成政府支付這12億令吉款項後,翁詩傑將獲得2千萬令吉的“處理費”。據知,在翁詩傑發信支持及內閣原則下同意後,翁先獲得800萬令吉,不過,在內閣改組,拿督斯里納吉任財長後,這款項卻出現變卦。張氏以翁詩傑未完成工作,而拒支付餘款。

不過,有另一項傳言指,翁詩傑在出席一晚宴上,因其中一名出席者直指他不配當華人領袖,不如張慶信般敢於批評大耳窿事件,以及“張慶信更配當華人領袖”的話,而激怒向來氣量不大的翁詩傑,於是,後者指示有關方面盡快公布調查報告。

Eight months ago, Ong Tee Keat vowed to make public the report on PKFZ, this was however only realized recently.  Rumor has it that Ong was dissatisfied with the backbencher and CEO of Wijaya Sdn Bhd Dato’ Seri Tiong King Sing in failing to honour his promise on payment of  “handling fees’.

It is also rumored that both Ong and Tiong has come to consensus that once the government has made the payment of RM1.2billion, Ong will be paid a sum of RM 20million as handling fee.  According to sources, after issuing the letter of support and sought the principal agreement from the Cabinet, Ong has been paid a sum of RM8 million.  But after the reshuffling of the cabinet  whereby Dato’ Seri Najib Razak took over the profile of finance minister, there were changes to the circumstances.  Tiong has refused to settle the payment on the basis that Ong did not complete his task.

However, some said that it was due to and incident that took place at a dinner function that Ong attended.  He was accused by an individual present that he is not fit to represent the Chinese community, Ong was further compared to Tiong who had boldly spoken up on the loan shark issue, this incident has provoked the not very forgiving Ong and caused him to instruct the authority to “tell it all”.

PKFZ Scandal (Part 2): 明知不妙,依然支持付款? — TEE KEAT supported PAYMENT in midst of fiasco?

據普華古柏的巴生港口自由區調查報告指出,巴生港務局董事局於2008年2月5日批准最後一筆款項12億1千600萬令吉給KDSB,這款項是概括占建築費用8.5%,即初期工程的9千525萬6千令吉,但不包括專業費1億2千159萬令吉。

報告說,這項費用是比估計師所估計的6千300萬令吉,超出3千200萬人令吉。報告也說,這顯示董事部是KDSB所索取的款額及預算而批准。

不過,報告是沒有注明或提及翁詩傑支持港務局董事部的建議及獲得內閣的通過。

值得探討的問題是,若巴生港務局在這計劃上有舞弊或犯錯,翁詩傑支持支付款項給KDSB,是否有包庇之嫌?是否應該要負上一定的責任?

明日焦点:为何迟迟不公开报告?

PWC’s report on PKFZ shows that the PKA’s board of director had on 5 February 2008 approved the payment of RM1.2billion to KDSB, this is inclusive of 8.5% variation cost and the initial construction of RM95million however this is not inclusive of the professional fees of RM0.12billion.

According to the said report, this payment is RM32million higher than the estimation of 63million made by surveyor earlier. This shows that the Board of Director had approved the payment in toto as requested by KDSB,but if fails to indicate or mention whether Ong supported the payment and made suggestion that the Cabinet should pass it.

Food for thought, the PKFZ fiasco started as early as 2004, why did Ong support the payment to KDSB, does he not have to be responsible for this?

PKFZ SCANDAL :翁诗杰曾支持政府缴付12亿

巴生港口自由區事件再爆內幕!向來有“正直不阿形象的現任馬華總會長兼交通部長拿督斯里翁詩傑,原來曾在2008510日簽署一封支持巴生港務局董事部,支付最後一筆款項121600萬令吉給Kuala Dimensi公司的信函!

翁詩傑簽署的這封信函是致給當時財政部長拿督斯里阿都拉,信中要求財政部批准這一筆款項。

信函內容指出,港務局董事部已在200825日會議上,針對巴生港口自由區的發展成本估價進行討論及研究。同時也提出多項建議,包括:針對QS4KDSB之間的建築費是差額,大約6.23%。港務局董事部認為,KDSB提出的112千零6599538令吉44仙是合理及可考慮接受的。,以及初期工程的95256千令吉。

信函的第5項指出,港務局董事部已知道這項建築費是不包括建築成本的10%專業費。這項最後成本將用作重新計算攤還費用,包括根據港務局與KDSB簽署合約的利息。

令人感到吃驚的是,在普華古柏的巴生港口自由區調查報告的4.49項指出,這一筆款項是由巴生港務局董事所批准,但是,報告沒有指出有關款項是獲得交通部長翁詩傑的審核,以及獻議首相兼財長拿督斯里阿都拉批准及發出這筆款項。

而且,翁詩傑在誌期514日一封首相副機要秘書長信函中,還親筆催促加速批發這筆款項。

有消息指出,這筆款項最終在獲得財長原則上同意下,提呈內閣尋求通過。

在這事件上,翁詩傑看來是根據程序去支持這筆款項,但是否又犯上道德上錯誤呢?因為巴生港口自由區計劃早在2004年開始爆發連串醜聞,賬目已令人生疑,尤其政府在不知情下要承擔一家私人公司的信貸,難道翁詩傑完全不知情?

這好比當你知道A君無故要承擔B君的大耳窿債務時,為何你還要支持A君繼續去承擔另外的11億債務呢?
翁詩傑在月前出席檳城一項活動時指出,調查報告顯示巴生港口自由區的46億令吉債務涉及超額收費現象。但這封信卻又証明,翁詩傑本身也涉及支持政府去支付這龐大或疑過高的收費。….(明日待续)
